Mission Viejo Asphalt Paving is an asphalt paving contractor operating in Mission Viejo, California, and surrounding communities in south Orange County. Our services include but are not limited to asphalt paving, sealcoating, crack sealing, pothole repair, driveway paving, parking lot paving, asphalt resurfacing, asphalt milling, grading and excavation, drainage solutions, concrete curbing and sidewalks, parking lot striping, and speed bump installation.
All services are subject to availability, site conditions, and the terms of a written agreement or estimate accepted by both parties. We reserve the right to decline any project at our discretion.
Estimates provided by Mission Viejo Asphalt Paving are based on the information available at the time of assessment. An estimate is not a final price. The final cost of any project may vary from the estimate if actual site conditions differ from what was observed, if the scope of work changes, if material costs change, or if unforeseen conditions are discovered during the work.
Estimates are valid for a limited time as specified in writing. We will notify you of any significant pricing changes before proceeding with additional work beyond the agreed scope. Written authorization from you is required before we perform work that materially exceeds the original estimate.
We are not responsible for pricing errors on the Site, in marketing materials, or in verbal communications. Final pricing is confirmed only in a signed written agreement.
Once a project is scheduled, we will make reasonable efforts to begin and complete work on the agreed dates. We may reschedule due to weather conditions, material availability, equipment issues, or other circumstances beyond our control. We will notify you as early as possible of any schedule changes.
If you need to cancel or reschedule, please notify us as soon as possible. Cancellations made after materials have been ordered or after work has begun may result in charges for materials purchased, work completed, or costs already incurred on your behalf.
Weather-related delays are at our sole discretion. Asphalt work requires dry pavement and appropriate temperature conditions. We will not proceed under conditions that would compromise the quality of the finished work.
Payment terms are specified in the written agreement or estimate for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, we may require a deposit before work begins, with the remaining balance due upon completion.
Accepted payment methods will be specified in your written agreement. We do not accept payment in advance through this Site. Do not send cash through the mail.
Invoices not paid by the due date may be subject to a late fee as specified in your written agreement. We reserve the right to pursue collection of unpaid balances and to recover reasonable attorney fees and costs incurred in doing so.
You are responsible for ensuring that we have lawful access to the work site and that any required permits, HOA approvals, or neighbor notifications have been obtained before work begins. If access is delayed or denied due to circumstances within your control, we may reschedule the work and may charge for mobilization costs already incurred.
You are responsible for marking or disclosing the location of any underground utilities, irrigation lines, sprinkler heads, or other buried infrastructure near the work area before work begins. We are not responsible for damage to unmarked or undisclosed items.
You are responsible for keeping the work area clear of vehicles, equipment, and personal property before and during the scheduled work. Fresh asphalt requires clear access for equipment and adequate time to cure before vehicle traffic is permitted.
We stand behind the quality of our workmanship. Any warranty on labor or materials will be specified in your written agreement. Warranties apply only to work performed by us and are voided by misuse, modification, inadequate maintenance, acts of nature, or site conditions outside our control.
Asphalt is a natural material that will show wear over time, especially in California's climate. Normal surface aging, minor cracking from UV exposure or soil movement, and color changes are not warranty defects. We are not responsible for pre-existing site conditions, soil movement, or subsurface issues not disclosed or discoverable at the time of our assessment.
The Site and any information provided on it are offered "as is" without warranty of any kind. We make no representations or warranties about the accuracy or completeness of content on this Site.
To the fullest extent permitted by applicable law, Mission Viejo Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific project giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
All content on this Site - including text, images, logos, and design - is the property of Mission Viejo Asphalt Paving or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.
If a dispute arises between you and Mission Viejo Asphalt Paving, we ask that you contact us first at projects@missionviejoasphaltpaving.com to try to resolve it informally. Most concerns can be addressed quickly with a direct conversation.
If we are unable to resolve the dispute informally, either party may pursue resolution through binding arbitration or through the courts of California, as the parties may agree in writing. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms and any dispute arising out of your use of the Site or our services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings shall be brought in the appropriate courts located in Orange County, California.
